对制造、投放市场和使用某些危险物质、混合物和物品的限制
条目28
在法规(EC) No 1272/2008附件VI的第3部分中被分类为1A或1B类致癌物的物质,并分别列在附录1或附录2中。
限制条件:
在不违背本附件其他部分的情况下,下列规定适用于序号28~30 中的物质。
1. 不得投放市场或使用:
— 作为物质;
— 作为其他物质的组成成分;
— 在混合物中。
不可用于个别浓度大于或等于以下规定的物质或混合物,投放市场出售给一般公众。
— 欧盟法规(EC) No 1272/2008 附件6 第三部分中具体规定的相关浓度;
— 指令1999/45/EC 所具体规定的相关浓度。
在不违反欧盟危险物质与混合物的分类、包装和标签的欧盟法规之规定下, 供应商应在投放市场前确保该物质或混合物包装应以不可磨灭的方式清楚标示如下字样:
“仅限专业人员使用”。
2. 作为例外,第1 条不适用于以下情况:
(a) 指令2001/82/EC 和指令2001/83/EC 所定义的医药和兽药;
(b) 指令76/768/EEC 所定义的化妆品;
(c) 下列的燃料和石油产品:
— 指令98/70/EC 所涵盖的车用燃料;
— 作为车辆或定点燃料的矿物油
— 装在密闭系统中出售的燃料(如装液态瓦斯的瓶子)
(d) 指令1999/45/EC 中涵盖的绘画颜料;
(e) 列于附录11 中第一栏的物质,应用于第二栏中的用途,从第二栏规定的日期开始,该豁免将生效;
(f) 欧盟法规(EU) 2017/745 覆盖的医疗器械产品。
